    1.THE SUBJECT OF THE TICKETS.UA TERMS OF SERVICE

    1.1.     This Agreement to provide the services of ticket reservation, issuance and sales, as well as other services, by means of Internet site TICKETS.UA technical capabilities is concluded between “TICKETS.UA” LLC, which owns both property and non-property rights of ownership of the TICKETS.UA Internet site, and the user.
    1.2. When ordering services through the website TICKETS.UA the user agrees to the terms of the Agreement, set forth below:
    1.3. “TICKETS.UA” LLC shall provide the user with the services involving booking, ticket issuance and sales as well as other services in accordance with the terms of this offer, while the user shall pay for the services in the prescribed value.
    1.4. The present Agreement is considered concluded (acceptance of offer) from the moment of User’s confirmation of his compliance with the terms of the Agreement by means of setting the appropriate mark in the reservation dialogue on the TICKETS.UA Internet site. After that Agreement is considered as a basic document in official relations between “TICKETS.UA” LLC and the User.
    1.5. The present Agreement and the information, provided on the TICKETS.UA Internet site, are an offer in accordance with Art.633 of the Civil Code of Ukraine.
    1.6. The provisions of the current legislation of Ukraine shall apply to relations between User and “TICKETS.UA” LLC.

    2. TERMS AND DEFINITIONS USED IN THE PRESENT AGREEMENT
    The terms “We”, “Us”, “Our” and “TICKETS.UA” refer to the Limited Liability Company “TICKETS.UA” (“TICKETS.UA” LLC), with the power to effect the issuance and sale of Service on the behalf of and at the expense of Carriers and Service Providers.

    Site is a free and open for visual inspection, publicly available website, belonging to “TICKETS.UA” LLC located on the Internet at https://tickets.ua, as well as subdomain sites (avia.tickets.ua, gd.tickets.ua, bus.tickets.ua, hotel.tickets.ua, aeroexpress.tickets.ua, insurance.tickets.ua, citybreaks.tickets.ua, events.tickets.ua) which provide information on the schedule, fare and carriage charge, taxes, available space, trucking and other kinds of services provided by Carriers and/or Service Providers. The use of the Site is governed by the provisions of this Agreement and the current legislation of Ukraine.

    Acceptance of offer is a full and unconditional acceptance of the terms of the Agreement by means of operations made by the User, having the intention of using the Site for booking Services.

    Acceptance is a response of the person, to whom the offer is addressed, concerning its acceptance. Performing actions aimed at fulfilling the terms of the Agreement (service payment, etc.) by the person who has received an offer within the period prescribed for its acceptance is considered to be Acceptance.

    In case the conditions set forth below should be accepted, the private customer making the acceptance of this offer becomes the Customer (further on User, Purchaser, Client). Acceptance of the offer is equivalent to entering into agreement on the terms set out in the Terms of Service.
     
    Offer is the present document issued in the Internet at https://tickets.ua/en/content/agreement-bookings-creation-and-cancellation.html.

    Order, Booking, Reservation is a duly made Customer’s request for receiving the Services, personally chosen on Site, which provides reserving of Service, chosen on Site, for the definite person/persons. Booking may assume full or partial payment at the moment of reservation as well as payment within the designated period after booking tickets online. Unpaid booking shall mean that the order is reserved for a certain time and during this time it may be sold only to Client that has made the Order. Booking condition is defined by its status represented in “My Account” section.

    Service is a package of actions provided by the Provider of Services and/or Carrier to the Customer against payment. The scope of Service and the moment of its beginning are chosen by User personally, when creating an order, of the options represented on Site. In accordance with the present Agreement, Carriers and Providers of Services are not required to provide any services other than those stated while creating Order on “TICKETS.UA” Internet site. The list of services provided to Client under the Order may be changed by Carrier or Service Provider unilaterally and without Customer being informed. TICKETS.UA provides services in accordance with the terms of Partner/Agency/Subagency Contracts with Carriers and Service Providers.

    Electronic passenger ticket, itinerary receipt, insurance, electronic voucher is an electronic digital document stored in the Service Provider’s system or in the global Reservation System. It contains comprehensive data on Services, displays the identity of Seller, Carrier (Company, providing Services), Buyer and Passenger, as well as certifies the purchase of Service, confirms the right of the persons mentioned in the document to use Service and requires the Carrier (the company, providing services) to provide the Service. It is provided by the Site or the Service Provider directly to the Buyer/Passenger in the electronic form: itinerary receipt/ e-ticket / insurance / electronic voucher.

    Booking System is the information system containing information about the full range of Services available for booking and purchase on Site. The information mentioned above is posted on the website www.Tickets.ua in full accordance with the way it is presented in booking systems by the direct suppliers of these services (carriers) or their authorized representatives. The information in the reservation system may be modified or supplemented at any time, in this regard the user is offered to use the booking system in an "as is" mode.

    Section "My Account" is a restricted area of the site TICKETS.UA, available only to users who have got registered and authorized, and it contains the following subsections:
    • "My Reservations," which contains information about all the Customer’s Orders;
    • "Buyer Information," a mechanism for storing and editing the data of Buyer;
    • "Passenger Information," a mechanism for storing and editing the data of Passengers for the subsequent bookings on the Site;
    • "My Bonuses," which contains information about the current balance and the history of bonuses;
    • "Account Settings," a mechanism for changing the password of Buyer.
    User / Passenger is a legally capable physical person who has attained the age of 18 and has the legal right to enter into contractual relations with "TICKETS.UA", including the right to place an order or to book online services on www.TICKETS.UA. He may be specified either as a recipient of services, or the person using the services, purchased online on www.TICKETS.UA only for personal, household and other needs not related to business activities, in any other way. Buyer may also be defined as Passenger / User.

    Carrier is a company directly providing the passengers with the carriage Services, selected and paid for by means of the system of booking and payment on the Site.

    Service Provider is the company which provides travel services offered on the site and is an official, legitimate partner of the Site. Service provider may be the Company providing services.

    Electronic payment system is a legal entity, technical infrastructure, accepting payments from the Buyers on the Site "TICKETS.UA" for the services offered on the Site on a contractual basis.

    3. THE USE OF THE WEBSITE
    3.1. The user shall read this Agreement and agree to its terms when ordering any of the Services on the Site.
    3.2. Using the automated system of the www.TICKETS.UA website and the services related to it means that the user fully agrees with:
    • the terms of this Agreement;
    • any amendments to this Agreement;
    • Terms and Conditions of the purchase, use and return of the Services, governed in their turn by the applicable laws, regulations and terms of the Service Provider, set out on the relevant IT services of the Site;
    • privacy policy;
    • anti-fraud policy;
    • Offer Agreement of the Service Provider in case it is present on the selected IT service of the website where the User is booking the Service, and which can be offered to the User regardless of his acceptance of this Agreement of  TICKETS.UA website. All contracts the information on which is available on this Site are concluded by the Buyer directly with individuals providing these services;
    • If the User does not agree with the Agreement, he has the right to refuse to use IT services and the Service provided by TICKETS.UA.
    3.3. Mandatory Terms of Use of www.Tickets.ua.  The user confirms that:
    • The user is 18 years old or more.
    • The user has all the civil rights, formal legal capacity and legal capacity to act.
    • User shall use this website only in accordance with this Agreement.
    • All information submitted by the user on this Site is true, accurate, relevant and complete.
    • The user shall use this web site only for booking/ purchasing services either for himself or other individuals on whose behalf he has the legal right to act.
    3.4.  Means of information support of orders provided by www.TICKETS.UA:
    1. www.TICKETS.UA offers an opportunity for users to get any advice on the questions of reservation, registration, sale, receipt, exchange or refund of the Services 24 hours a day. For getting advice User should contact Customer Support. 
    2. The validity of e-mail notification: e-mail is the main communication channel between the Site and the Buyer. User agrees that all the letters received from the Site in electronic form correspond to the same legal requirements as the communication represented in physical printed terms.

    4. REGISTRATION ON THE SITE
    4.1. In order to make use of the Website, the User should mandatorily get registered on the website. When getting registered the User shall provide the following data:

    • e-mail address (later used as a login);
    • name and surname;
    • contact phone number.

    4.2. The password is automatically generated and sent to the User by email after registration.
    4.3. The Customer may register with the Site in three ways:

    1. Complete registration by filling in the form on the Site.
    2. Quick sign-up by means of filling in the form using your profile on social networks; but later on the User undertakes data specified by provision 4.1 of this Agreement.
    3. Automatic registration upon booking – however, the User undertakes to eventually provide data specified by provision 4.1 of this Agreement.

    4.4. User has the right to have quick access to his orders and personal information on the Site at any time, by means of using the e-mail address, indicated when making the order, and the password received by e-mail after registration. User can use the password reminder on the Site, if necessary.
    4.5. Registering on website www.TICKETS.UA (during ticket issuance) User agrees:

    1. To comply with Contract Regulations, as well as the terms provided by Privacy Policy, Anti-Fraud Policy, all alterations and amendments that can be added to this Agreement.
    2. To timely update the contact information indicated when registering, following its accuracy and relevance.
    3. To keep the log-in data on the Site confidential.
    4. To receive commercial information about tourist services provided by www.TICKETS.UA.

    4.6. If the User has a member account on www.TICKETS.UA (“My Account” Section), he/she will have access to his account and shall be held fully and solely liable for any use of his/her account. Any actions performed on the site in “My Account” Section by means of the User's account data (e-mail, password) shall be deemed to be done by the User himself.
    4.7. The buyer may omit the use of the Site by removing his personal information and account "My Account". The removal request must be sent from the email address registered on the site to the e-mail of Support Service info@tickets.ua. After the removal the User will not be able to restore his entries in "My Account" Section (including the list of orders on all the services, the accumulated bonuses, credentials).
    4.8. "TICKETS.UA" LLC is not responsible for the accuracy and correctness of information provided by users in the process of registration.

    5. GENERAL RULES: TICKET RESERVATION, PURCHASE, CALCULATIONS, TERMS OF PAYMENT
     
    5.1. GENERAL RULES: TICKET RESERVATION
    5.1.1. The Booking System includes the following information: flight schedules, rules of transportation, categories and characteristics of the vehicles (for transport services), the types of vehicles data, space availability assignments, Carriers’ and Service Providers’ fare, regulations on its use, the list of services offered.
    5.1.2. The above information is posted on the website, in full accordance with the way it is presented in reservation systems by Suppliers of Services or their authorized representatives. The information in the reservation system may be altered or added at any time, in this connection it is suggested that the User should operate this reservation system as used at the moment of its use.
    5.1.3. Making an online reservation via the Website, the Buyer shall provide his personal information specified in Sec. 4.1. of this Agreement, as well as personal information of Passengers: last name, first name, middle name (if any), ID details, date of birth, gender, and citizenship.
    5.1.4. During ticket reservation, the User shall fill in all the fields specified in the reservation system as "mandatory."
    5.1.5. Change of personal data of any of the passengers in the official order brings about the situation when fares agreed in the Order lose validity, as it may be necessary to refund the tickets purchased under this order and to make a new one so as to change the data in the Order of the Passenger. Thus, the buyer assumes all the possible commercial risks (tickets refund, payment of the cost of alterations, a new checkout, variation of charges, refund and so on.), related to his wrongful actions with committing errors and inaccuracies while providing personal data of the passengers.
    5.1.6. If the user of the website www.TICKETS.UA made a booking without paying for it within the terms of payment, such booking will be automatically canceled by the system within the period, specified by Service Provider. No cancellation fees for the unpaid booking are stipulated in the Agreement.
    5.1.7. If the service includes a discount for children and / or infants, at the date of landing or beginning to use the Service the age of the child /infant should correspond to the appropriate age categories, such as "child" and "infant", established by the Service Provider.
    5.1.8. The passenger whose full name, specified in the order, does not correspond to that indicated in the ID is not allowed to obtain services.
    5.1.9. Orders made by User are final and should be subject to automated processing in the processing system of "TICKETS.UA."

    5.2. GENERAL RULES. PURCHASE
    5.2.1. The service is considered to be provided properly and in full amount when the electronic version of the paid order of a standard form, which is the basis for travel or receiving services, has been sent to the Buyer at his/her email address specified during registration of the order; and / or after the display of paid orders and the possibility to download the paid order form in "My Account" on the site.

    5.3. GENERAL RULES. PAYMENT
    5.3.1. Acting on his own authority the Buyer chooses the appropriate method of payment order among those possible for this provision of services and type of Service.
    5.3.2. Buyer authorizes www.TICKETS.UA or the Carrier to withdraw the total price of the reservation indicated on the Site, including the commission, the corresponding margins of payment systems and the amount of potential conversion of all purchases made, from the specified bank account via the chosen payment method.
    5.3.3. The Buyer is solely responsible for all fees and commissions and other costs, specified by the bank that can be added to the cost of the credit card issuer.
    5.3.4. The Buyer agrees to the processing of his personal payment information.
    5.3.5. When selecting the Credit Card payment method, the Buyer indicates billing information related to bank cards, namely, card number, expiration date, CVV-code.
    5.3.6. The Website reserves the right to refuse to provide the Service or to request for additional copies of the cardholder’s official papers if there is sufficient evidence to suggest that the transaction on credit card, used for paying for the order, may be considered fraudulent.
    5.3.7. As specified by the Resolution of the National Bank of Ukraine  "On operations with the use of special means of payment" as of 30.04.2010, № 223, operations with bank cards shall be made by either the card holder or his authorized representative.
    5.3.8. All orders booked on the Website and paid by credit card are checked by  "TICKETS.UA" LLC in order to prevent the cases of various kinds of misuse or fraudulent use of credit cards when paying for the services. According to the rules of international payment systems, in order to verify the identity of the owner and his eligibility to use the card, User that has issued such an order shall provide two pages of the holder of a credit card’s passport - a double page spread with the photo and the copy of a credit card on both sides (the card number should be concealed, except for the last four numbers) by e-mail as a scanned copy, upon the request from the Operator. Should the User fail to provide the required documents within the period specified in the request of "TICKETS.UA” or when there are doubts as for their authenticity, “TICKETS.UA" LLC reserves its right to cancel the order without giving any reason. The cost of the Order is returned to the card of the card holder.
    5.3.9. Bank and bank card fees.

    1. If the reservation is made outside of the country where the bank card was issued, the bank may convert the paid amount into local currency and take a commission for currency exchange, and also the commission for international operations may be included. This means that the amount stated in the report on the status of a credit card can be in local currency, so the figure may appear different from the one that was listed on the final page of the booking fees on the Site. The company or bank that issued the card may consider booking of international travel as international transaction, because www.TICKETS.UA can transfer payment services to international travel providers.
    2. The exchange rate and the size of fees for international operation are determined only by the buyer's bank on the day when the transaction is processed.
    3. Exchange rates are based on the variety of sources available publicly, and should be used only as a recommendation. The course may not be accurate, and the actual exchange rate may vary. The exchange rate is updated every day.

    5.4. GENERAL RUES: TICKET REFUND
    5.4.1. Refunds are always made in accordance with the current legislation of Ukraine and the fare rules established by Carriers and Service Providers.
    5.4.2. The procedure of refund application and technical procedures of it are subject to the Rules and Special Aspects of the refund for each particular service which includes the purchased service.
    5.4.3. The Site's Customer Support has right to request that the Buyer, initiating a refund, should provide scanned copies of additional documents: personal identification documents, statements, references about background information, certificates and other papers confirming the reason for the refund, as well as a bank statement if dealing with controversial financial issues.

    6. SPECIAL ASPECTS OF THE USE OF THE SITE SERVICES

    6.1. FLIGHT TICKETS

    6.1.1. BOOKING

    6.1.1.1. Under the rules of certain airlines, with the availability of a patronymic in the passport of the passenger, for whom the booking is made, the buyer should specify it in the appropriate field when booking.
    6.1.1.2. It is possible to buy or book a ticket not later than six (6) hours prior to the departure on the site www.TICKETS.UA.
    6.1.1.3. In case of the flight delay or cancellation resulting in the passenger’s failing to board the flight, www.TICKETS.UA is entitled to collect, store and process the information, necessary for bringing claims against the Carrier, as well as to communicate with the buyer referring to the contact information specified in his bookings in order to clarify the possibility of bringing claims against the Carrier so as to obtain compensation.
    6.1.1.4. The Customer may order and pay for the transportation of excess baggage during ticket purchase. According to the rules of airlines, the price of additionally bought services, regardless of whether or not they were used by the Passenger, including transportation services of excess baggage is not refundable. Requests for the refund of excess baggage transportation may be considered by airlines individually. You need to submit a written request to our email: helpdesk@tickets.ua and indicate your booking reference number in the subject line. Since the final decision is made by the airline representatives, TICKETS.UA LLC cannot guarantee the fact and the sum of refund. The payment system fee and the service charge of TICKETS.UA LLC, regardless of the company's decision, are not refundable.
    6.1.1.5. The Customer may check availability of and order additional Services through Customer Support—namely, special menu, choice of seats on board, application for carriage of animals, non-standard and excess baggage, apply for assistance in boarding/disembarking of disabled people and accompanying of children.

    6.1.2. CALCULATIONS AND PAYMENT
    6.1.2.1. "TICKETS.UA" LLC shall not be liable if unredeemed airline seats are taken by the airline company. In addition to the above there may be no possibility to rebook tickets at the same price.
    6.1.2.2. The rules of carriage, airline service and fare are valid during reservation and can be changed by the air carriers until ticketing, without the passengers’ being informed. If the initial price does not correspond to the actual price at the moment of the ticket issuance, the Site's administration shall notify the Buyer of the change in the value and has the right to invoice Buyer for the additional charge.
    6.1.2.3. If issuance of the paid ticket has been postponed at the request of the Buyer, the ticket price or tariff may be changed by Airline Carrier after the reservation expiry (3 hours), and the seats will be back on sale.
    6.1.2.4. Currency conversion when you pay:

    1. The currency of ticketing may differ from the currency of the order, so in this connection currency conversion is quite possible during a further ticket return.
    2. As some airlines have open accounts in foreign banks, the request for cancellation of the order value may come from the banks outside of Ukraine. In such cases, the issuing bank can make money conversion, which depends on the card currency, transactions currency, as well as tariffs and exchange rates used by the issuing bank. Conversion may also occur at the stage of refund.
    3. "TICKETS.UA" LLC will not meet Customers’ expenses in case of additional conversions, as the company does not take part in the formation of policy interaction between the participants maintaining the transaction since the moment of its formation up to the moment of money withdrawals from the customer's account, as well as Payment of funds into an account as the result of ticket return.


    6.1.3. TICKET RETURN. CHANGES
    6.1.3.1. In addition to possible fines imposed by airlines, "TICKETS.UA" LLC is entitled to withhold the service fee for the reticketing service (250.00 (two hundred and fifty) hryvnia including VAT per passenger (excluding infants)) and ticket return (300.00 (three hundred) hryvnia including VAT per passenger (excluding infants)). In case of involuntary refund, booking service fee is not applied.
    6.1.3.2. The decision concerning fines in case of involuntary refund through no fault of Airlines depends solely on the regulations of ticket fare and is taken by the Airline. In such case service return fee shall be charged.
    6.1.3.2. The cost of additional services, commission fee paid when buying a ticket, as well as payment systems extra charge will not be returned.
    6.1.3.3. Buyer will receive the money for the unused ticket in the same way that the order has been paid.
    6.1.3.5. The terms of any changes in the compiled travel documents (e-tickets), service cancellation, ticket return, as well as other terms of the services provided by their suppliers are regulated by fare rules existing for the service, the Contract for Air Carriage concluded with the Airline Company, the Contract for Rendering Services concluded with Site, Air Code of Ukraine and other legislative acts of Ukraine, and may assume the imposition of penalties on the buyer.
    6.1.3.6. Refunds for unperformed air transportation or failing to render services are granted in accordance with the terms read and understood by the users during the process of booking.
    6.1.3.7. To make a request for the ticket exchange or refund, the Buyer shall use the appropriate technology on the site www.TICKETS.UA in "My Account" section. The Feasibility and cost of ticket changes, the calculation of the amount to be refunded shall be in accordance with Fare Rules on the date and time, calculated as the date and time of the claim for the refund.

    6.1.4. Special aspects of booking the tickets by segments:
    6.1.4.1. In case of exchange / refund of the order, Fare Rules apply to each ticket separately.
    6.1.4.2. In case of flight cancellation or shift by the Carrier, the passengers will be offered the alternative or refund only to the flights drawn in a single ticket.
    6.1.4.3. In case of a request for refund/change of the order by the Passenger due to such reasons as illness / death of the passenger or a close relative, the denial of visa – the documents confirming the reason for the request will be considered for each electronic ticket individually.

    6.1.5. The peculiarities of ordering tickets provided by low-cost carriers (budget airlines).
    During purchase of tickets for low cost flights provided by the carrier, the following terms of the contract shall be kept to:

    1. The funds on the Customer's payment card may be directly drawn by the Carrier. During the processing of a transaction, the Carriers may apply additional fees and charges. Thus, the amount due, which is displayed on the Site, may differ from the amount charged to the Customer's payment card. Such change of price with additional fees and charges will not be considered a violation on the Agency's part.
    2. When you create a Reservation, you agree that you were informed of the flight ticket pricing and payment terms and unconditionally accept the specified terms. You accept and agree that the Agency may not be liable for additional fees and charges, which are applied by the Carrier, because it provides the Carrier's pricing policy information to the Customer but does not participate in the pricing itself from the moment of its provision to the charging of Customer's account as well as when funds are credited to the Customer's account during ticket refund.
    3. The payment shall be made only by means of the bank cards Visa and MasterCard.
    4. Reservation number certified by the airline, shall confirm the possibility of a flight while e-ticket number is not assigned.
    5. Passengers shall not use the Tickets bonuses, accumulated in the bonus program Tickets.ua to pay for the tickets provided by low-cost carriers. Bonuses for the paid tickets of low-cost carriers shall be charged according to the standard rules of participation in the bonus program.
    6. The change of the route or the name of Passenger shall not be possible.
    7. A paid ticket shall not be refundable.
    8. Carrier shall the right to apply special conditions concerning the rules of luggage transportation and check-in. As an intermediary "TICKETS.UA" LLC shall not affect the terms of the Carrier's Service.
    9. The Fare Rules shall be available on the payment page when making the order.

    6.1.6. The peculiarities of child carriage under airlines responsibility: 
    6.1.6.1. When transporting unaccompanied children under 16, it is obligatory for accompanying part to have available notarized document stating the name and surname of the escort by the airlines.

    6.2. TRAIN TICKETS

    6.2.1. GENERAL TERMS
    6.2.1.1. The Passenger must get informed about the procedure of entraining.
    6.2.1.2. The Passenger must comply with the requirements of the Carriers and transport regulations laid down by them, including the requirements as for the use of the ticket, the ticket cancellation, the availability of the document for boarding the train, etc.
    6.2.1.3. The responsibility for compliance with the requirements of the Carriage Rules rests on the person using the service, and / or the person using the ticket.
    6.2.1.4. "TICKETS.UA" shall consider the customer’s requirements and complaints brought about by non-compliance with / violation of transport regulations, non-compliance with deadlines and so on, even if the client has not been acquainted with the rules of transportation of the company.
    6.2.1.5. "TICKETS.UA" LLC shall not be liable in case of the train’s delay or cancellation.

    6.2.2. TICKETS FOR THE TRAINS of “Ukrzaliznytsya” (National Rail Transport Authority of Ukraine)

    6.2.2.1. BOOKING
    The terms of booking tickets for the trains of "Ukrzaliznytsya" are essential terms of the Agreement and can be found here: https://gd.tickets.ua/en/content/how-to-book-train-ticket.html
    6.2.2.1.1. The reservation of rail carriage is available via two methods:

    1. Purchase with the payment in full for booking on the site – after the successful payment for booking the customer receives a 16-digit number. Depending on the direction and the train, it may be required to exchange the  the ticket reference number at the booking office, or the printed form may be used as a ticket without any exchange and suitable for travel.
    2. Reservation payment and the subsequent purchase of tickets at the box office – after successful payment for booking services the customer receives a 14-digit number, requiring the cost of tickets to be paid in the railway office.

    6.2.2.1.2. Receiving (or redemption) of paper tickets ordered online at the railway ticket office is to be made by the Customer before the expiry of the due term of ticket exchange (or redemption) indicated while booking.

    6.2.2.2. SETTLEMENTS AND PAYMENT PROCEDURE
    6.2.2.2.1. The service of train ticket sale is considered to be completed in full amount since the date when, by means of the Internet site TICKETS.UA, the customer was provided with the unique number of online reservation in the form that allows to copy (overwrite) it or print it as a form of online order.

    6.2.2.3. REFUND
    6.2.2.3.1. The unused railway ticket can be refunded by means of returning it to the return booking office of the railroad station:

    • ticket with deferred printing must be previously exchanged for a paper ticket at the railway office no later than the due time of exchange expires.
    • e-ticket that does not require any exchange must be printed on the printer and then handed over to the return ticket office.

    6.2.2.3.2. Customer will be given a supporting document showing the amount of a return. The funds will be transferred to the bank account from which the ticket was paid.

    6.2.3. TICKETS FOR THE TRAINS OF EUROPEAN RAILWAYS

    6.2.3.1. BOOKING
    6.2.3.1.1. The terms of booking tickets for the trains of European Railways are essential terms of the Agreement and can be found here: https://railway.tickets.ua/en/content/euro-how-to-book.html
    6.2.3.1.2. Providing the Buyer with the order form (waybill) is the proof that the ticket for the train of European railways has been paid.
    6.2.3.1.3. European rail carriers generate Control coupons themselves. The user receives Control coupons in the form, generated by the carrier, so the type of transportation document may be different.
    6.2.3.1.4. The types of shipping documents:

    • A single order form, containing one page, regardless of the number of passengers, is generated for all the order forms. The document is sent to the mail address indicated during the order creation, and is also available in "My Account."
    • A separate order form containing multiple pages, according to the number of passengers is formed for each passenger. The document is sent to the mail address indicated during the order creation, and is also available in "My Account."
    • The order is given a confirmation number. This number is either the interchange code, on the basis of which the passenger receives a boarding pass in the "ticket machine", or it gives the passenger a possibility to board the train directly. The order form with a confirmation number is sent to the e-mail specified during the creation of the Order, and is also available in "My Account."

    6.2.3.2. SETTLEMENT AND PAYMENT
    6.2.3.2.1. User agrees that the rules of transportation, ticketing rules, and cancellation policy are established, regulated and changed by each of the carriers; and "TICKETS.UA" LLC has no influence on the decisions of the Carrier concerning these changes.
    6.2.3.2.2. The user should take into account that in some cases, booking system provides information about the total cost of the order consisting of a few tickets, and not the cost of each ticket separately.

    6.2.3.3. REFUND
    6.2.3.3.1. The possibility of refund and return policy depend on the fare rules of the purchased ticket. The buyer must get acquainted with the Rules and Regulations of the Carrier’s tariffs before the creation of the order.
    6.2.3.3.2. Return ticketing is possible only if such a procedure is provided by the Carrier.
    6.2.3.3.3. Refunds are made after receiving compensation by the Site from the Carrier.
    6.2.3.3.4. It is not possible to return one or more tickets of the same order. The entire order should be revoked completely.
    6.2.3.3.5. Under no circumstances the cost of services of "TICKETS.UA", the cost of services of ticket providers, penalties of the Carriers and extra charges of payment systems may be refundable.

    6.2.4. TRAINS TICKETS FOR “AEROEXPRESS”

    6.2.4.1. BOOKING
    6.2.4.1.1. The terms of booking tickets for the trains of "Aeroexpress" are essential terms of the Agreement and can be found here: https://aeroexpress.tickets.ua/en/content/aeroexpress-how-to-book.html
    6.2.4.1.2. Providing customers with itinerary form (e-ticket) is the proof of    payment for the ticket for the "Aeroexpress" train.
    6.2.4.1.3. The passenger is responsible for compliance with the Rules of the use of the ticket and Transport Regulations, for the ticket being printed in a proper way and in the period of the ticket validity.

    6.2.4.2. GENERAL RULES OF TRAVEL
    6.2.4.2.1. General rules for travel on "Aeroexpress" trains are essential terms of the Agreement, they can be found here: https://aeroexpress.tickets.ua/en/content/aeroexpress-oferta.html
    6.2.4.2.2. The Passengers of "Aeroexpress" trains are not allowed to damage or pollute the indoor equipment of the carriage, the glass of locomotives and carriages or things belonging to other passengers in any way.
    6.2.4.2.3. The Passengers have no right to disturb other passengers, to smoke in carriages and vestibules, drink alcohol, and to be in a state of alcohol intoxication.
    6.2.4.2.4. The Passenger can be taken away from the electric train by the employees of the Department of Internal Affairs and guards, traveling ticket cashiers (flight attendants) and medical workers.
    6.2.4.2.5. Corporate Ticket cashiers (flight attendants) have the right to collect the fare for traveling without travel documents, for the carriage of overweight and oversized luggage and for carry-on baggage from passengers; and in case of the passenger’s failure to pay the fare they can take measures for taking the passenger off the train.

    6.2.4.3. THE RULES OF CARRIAGE OF ANIMALS AND BAGGAGE
    6.2.4.3.1. The rules of bringing animals and luggage in the "Aeroexpress" trains are essential terms of the Agreement, they can be found here: https://aeroexpress.tickets.ua/en/content/aeroexpress-pets-baggage.html
    6.2.4.3.2. The fare is charged according to the tariffs. Payment for excess baggage or bulk items and animals allowances is made only at the box office. A received cash receipt which specifies the amount and the name of the service, is the evidence of successful payment.
    6.2.4.3.3. The passenger is entitled to have a free carry-on baggage, weighing no more than 36 kilograms and the size of no more than 180 cm after the sum of 3 dimensions on one of travel documents.
    6.2.4.3.4. On account of the established norms the plants, not exceeding the height of 180 cm are allowed for the carriage.
    6.2.4.3.5. Transporting small pets, dogs and birds, one undismantled bicycle, as well as electronic, household, video and audio appliances, not exceeding 180 cm after the total sum of 3 dimensions is allowed at additional charge.
    6.2.4.3.6. Ensuring the integrity and preservation of hand luggage carried by passengers is the responsibility of the passenger.

    6.2.4.4. THE RULES OF CARRIAGE OF PASSENGERS
    6.2.4.4.1. Regulations of the carriage of passengers on trains "Aeroexpress" are essential terms of the Agreement, they can be found here: https://aeroexpress.tickets.ua/en/content/aeroexpress-children.html
    6.2.4.4.2. For traveling by electric trains the passenger must purchase a ticket for a single trip in one direction, keep the travel documents acquired for the trip up to the moment of exit through the checking booth, submit his travel document to a roving ticket clerk and present supporting documents to a ticket clerk in case of his having the right to benefits.
    6.2.4.4.3. A travel document (ticket) for a single trip is valid for one trip in one direction in accordance with the date specified therein. Individual tickets issued by other commuter rail carriers are not valid in "Aeroexpress" trains.
    6.2.4.4.4. The passenger is entitled to free transporting of children aged under the age of 5. For children aged five to seven years the passenger must purchase half-free tickets. At the request of the cashier doubting the appropriate age of the child, the passenger is obliged to exhibit supporting documents.
    6.2.4.4.5. Arranging travel documents for the person, entitled to payment of a discount or free travel fare, is made in the order, and developed in accordance with the applicable legislation of the Russian Federation.

    6.2.4.2. TICKET RETURN
    6.2.4.2.1. If you cancel the ticket for "Aeroexpress" train the total value (excluding fees for the return in the amount of 15.00 (fifteen) hryvnia, as well as the payment system charge, retained by the bank when paying the ticket) shall be refunded.
    6.2.4.2.2. If an Aeroexpress train ticket has been reserved together with  a flight ticket, a fine of 15.00 (fifteen) hryvnias is levied for the changes in the train ticket.

    6.3. BUS TICKETS

    6.3.1. GENERAL TERMS
    6.3.1.1. "TICKETS.UA" LLC renders services in accordance with the partnership agreement for the sale of bus tickets for bus tours of the carriers.
    6.3.1.2. "TICKETS.UA" LLC is not liable for incidents that may occur to the passenger when issuing pre-paid tickets or boarding the bus.

    6.3.2. BOOKING
    6.3.2.1. The terms of the use of the service "buses" are the essential terms of the Agreement, they can be found here: https://bus.tickets.ua/en/content/bus-how-to-book.html
    6.3.2.2. The cost of bus tickets is determined according to the rules and fares applicable to the bus terminal server (the bus station, the carrier) at the time of booking and payment. In the case of tariff or regulations changes, the operations carried out under the previous rules / tariffs are valid and are not subject to re-issuance.
    6.3.2.3. Providing the Buyer with the voucher (electronic ticket) by e-mail is  the proof of payment for a bus ticket.
    6.3.2.4. Depending on the Service Provider, the voucher may be of the following types:

    1. The voucher requiring exchange for a ticket at the box office. Ticketing through vouchers is done at the box office of the bus station for free, without waiting in a queue, and terminates five (5) minutes before the scheduled departure of the bus. The ticket can be issued and given only to the person whose name is listed in the voucher, upon availability of the identity document.
    2. The voucher, requiring exchange for a ticket whilst boarding a bus. The exchange is carried out by the driver of the bus. The form of the ticket, given to the Passenger in the bus is determined by the document "Administrative order of the Ministry of Transport and Communications of Ukraine №503 of May 25, 2006».
    3. The ticket voucher giving right to travel by bus.

    6.3.2.5. The Site www.TICKETS.UA provides you with an opportunity  to buy a bus ticket no later than four (4) hours before the scheduled departure of the bus.
    6.3.2.6. It is possible to reserve not more than five (5) seats in one order.

    6.3.3. SETTLEMENT AND PAYMENT
    The cost of Services of TICKETS.UA" LLC is charged at the same time as payment of tickets and is non-refundable.

    6.4. TRANSFERS

    6.4.1. BOOKING
    6.4.1.1. The terms of use of the “Transfers” service are essential conditions of the Contract, they are available at https://transfer.tickets.ua/en/content/transfer-how-to-book.html
    6.4.1.2. The transfer service can be paid for only with a Visa/MasterCard card issued by a Russian, Ukrainian, or European bank.
    6.4.1.3. A confirmation of payment for a successful order is a transfer voucher, sent to the Customer's email address, which is also available in “My account”.
    6.4.1.4. A text message with the carrier's contact details will be sent to the phone number, specified during order placement.

    6.4.2. VOUCHER REFUND
    6.4.2.1. The refund of an issued voucher is only possible if such procedure is allowed by the Carrier.
    6.4.2.2. Route changes, as well as changes in the first and last name of the passenger, are not allowed. If there is a need for a change, the existing order must be canceled and a new order including all the necessary modifications placed.
    6.4.2.3. An order may be canceled without any penalties before the transfer takes place, but only within a deadline set by the provider. If an order is canceled after the deadline has expired, a penalty equaling the cost of the transfer is charged. In case of flight cancellation the transfer is canceled without any penalties.
    6.4.2.4. The surcharge of the Tickets.ua payment system and carriers' penalties (if there are any) are nonrefundable under any circumstances.
    6.4.2.5. Order cancellation terms are available:

    • on the payment page during order placement;
    • in “My account” upon authorization;
    • in the received transfer voucher.

    6.5. HOTELS

    6.5.1. GENERAL TERMS
    6.5.1.1. TICKETS.UA LLC provides the hotel booking services to the Customers. The hotel service provision relations emerge directly between the Hotel and the Customer.
    6.5.1.2. Controversial hotel issues may be solved by the Passenger with the help of the Support Service of the Provider by means of the contacts listed in his/her electronic reservation voucher.

    6.5.2. BOOKING
    6.5.2.1. The terms of the use of the "Hotels" service are essential terms of the Agreement, they may be referred to at https://hotels.tickets.ua/en/content/hotels-how-to-book.html
    6.4.2.2. The service of the hotel reservation is considered to be provided after submitting to the Purchaser the e-vouchers under the standards of Service Provider.
    6.4.2.3. The type of tariff, the terms of cancellation of, and application of the changes to, the booking, the set of services included in the order, the services offered by the hotel for additional fee are determined by the terms of booking and are ticked during hotel reservation on the site Tickets.ua.
    6.4.2.3. By confirming the booking of services, the Customer confirms that he/she accepts the terms of booking, price and conditions of service provision, available payment method and accepts such terms and conditions.

    6.5.3. CALCULATION AND PAYMENT
    6.5.3.1. The method of payment for the hotel services is determined by the Service Providers. The payment for the hotel services may be carried out via the following methods:
    1.Prepayment
    1.1. Charging of total price to Customer's card during reservation on the site www.TICKETS.UA.
    1.2. In the event of prepayment, a booking confirmation may be required. If booking confirmation is required, the funds will be blocked for 14 hours, and upon booking confirmation, they will be charged to your account. In the absence of booking confirmation, the funds will be unblocked. You will be informed thereof by means of an email message.
    1.3. The funds are charged in the hotel's currency. In the event that currencies of billing and of card do not coincide, conversion may apply.
    2. Payment upon arrival—payment for the services is made directly at the hotel. The Customer's card may be preauthorized in order to guarantee reservation. The order price is blocked during reservation of services on the Website.
    6.5.3.2. The actual tax and fee amount depends on the internal regulations of the hotel and its location. Taxes and fees are not always included in the cost of the reservation. The Information on taxes and fees is indicated during reservation on the Website.
    6.5.3.3. The User books the selected services at full cost thereof, indicated on the Website. Funds are charged in the currency of the hotel. In the event that the billing currency and the bank card currency do not coincide, conversion may apply.

    6.5.4. REFUND, CHANGES, AND NO-SHOW
    6.5.4.1. The Customer may cancel the reservation by using the corresponding technology on the Tickets.ua website in "My Account" section. The Customer may incur a cancellation/reservation change/no-show penalty, which is determined by the terms of the booking.
    6.5.4.2. Processing an application for a refund and the refund itself is the sole responsibility of the service provider, and is made according to the rules and terms established by the latter.
    6.5.4.3. The Customer may request a change in the order by contacting the support services of the provider via the contact information indicated in its electronic reservation voucher.
    6.5.4.4. TICKETS.UA LLC is not responsible for the refund to the Customer by the hotel, the possibility of making changes in the reservation and other booking operations.
    6.5.4.5. The Hotel Rules may provide a no-show penalty. In the event of prepayment or credit/debit card preauthorizarion, the order amount, excluding the no-show penalty, will be unblocked/returned to the Customer.

    6.6. CITY BREAK

    6.6.1. RESERVATION
    6.6.1.1. The rules of the City Breat service use are inalienable conditions of the Agreement and can be found on: https://citybreaks.tickets.ua/en/content/citybreak-how-to-book.html
    6.6.1.2. The reservation service is considered to have been provided after the sumbission of the itinerary receipt and booking confrimation to the Buyers email, which may also be found in "My Account."

    6.6.2. SETTLEMENT AND PAYMENT PROCEDURE
    6.6.2.1. The payment for the "City Break" service can only be made with Visa and MasterCard issued by European, Ukrainian, or Russian banks.
    6.6.2.2. If the issuance of the paid ticket is postponed by the Buyer, the ticket or fare cost may be changed by the ariline carrier and the seats be back on sale.
    6.6.2.3. The procedure of payment for the accommodation may vary depending on the hotel and type of room. To learn the payment options is possible during reservation.
    6.6.2.4. Options of payment for the room:

    1. Limited number of rooms – the card may be charged on the day of reservation or soon after.
    2. Book right now and pay after check-in – the payment is made during check-out. In some cases, the hotel may block the funds without charging them. The amount blocked may exceed the reservation price, for the cases when additional services may be used. The term of refund may depend on the bank.  To learn about unblocking, and to unblock the funds, it is advisable to contact the bank.


    6.6.3. REFUND
    6.6.3.1. To cancel the refund, the User should select the corresponding option in "My Account."
    6.6.3.2. During the refund for the "City Break" service,  both the flight ticket and hotel room are canceled.

    6.7. INSURANCE
    6.7.1. The Insurance Rules, including the rules of use of the site during conclusion of Insurance Agreement, methods of payment, procedure for termination of Agreement, cancellation of insurance policy and other conditions of service provision are an inseverable part of the Terms of Service and vary depending on the insurance company which you have chosen. They are available via the following links:

    6.7.2. The conditions of the Insurance Agreement which will be concluded with the insurance company, insurance packages, actions of the Insured in the event of the insured accident are an inseverable part of the Insurance Rules and are defined directly by the insurance company.
    6.7.3. Amendments to the Insurance Agreement are not provided.
    6.7.4. Besides the method mentioned in Article 5.2.1, the Customer may obtain the Insurance Agreement in the section “My Account” by downloading the .pdf document.

    6.8. CONCERT TICKETS

    6.8.1. GENERAL TERMS
    6.8.1.1. “TICKETS.UA” LLC provides services according to the partnership agreements on event ticket sale.
    6.8.1.2. “TICKETS.UA” LLC is not responsible for the incidents that may happen while issuing the previously paid concert tickets and during the actual event.

    6.8.2. BOOKING
    6.8.2.1. Terms of the service “Concert Tickets” are an integral part of the Agreement which can be found at: https://events.tickets.ua/en/content/events-how-to-book.html
    6.8.2.2. The price of a concert ticket is determined according to the terms of use and fares that are currently available on the provider's server at the time of reservation and payment. In case of fare and/or terms changes, all the transactions, made under previous rules/fares remain valid and can not be reissued.
    6.8.2.3. As a confirmation of payment for the concert ticket, the Customer will get a voucher (an electronic ticket) at the email address.

    6.8.3. SETTLEMENT AND PAYMENT PROCEDURE
    6.8.3.1. Service price of “TICKETS.UA” LLC is charged together with the ticket payment and is not subject to refund.

    6.8.4. REFUND POLICY IN CASE OF EVENT CANCELLATION BY THE ORGANIZER
    6.8.4.1. In case if the event is canceled by the organizer, you have to complete the refund during not more than 10 calendar days from the date of the canceled event.
    6.8.4.2. The payment system fee is non-refundable.
    6.8.4.3. “TICKETS.UA” LLC is not obliged to inform the User about the event cancellation by the organizer.

    6.8.5. RULES OF TICKET REFUND
    6.8.5.1. To refund the paid ticket, you need to enter "My Account" and pressing "Cancel," submit the refund application to the provider for consideration whether the ticket is refundable under the rules of the organizer.
    6.8.5.2. If confirmed, the funds will be returned via the same method as the reservation was paid with.
    6.8.5.3. The payment system fee is non-refundable.
    6.8.5.4. In the event of denial, the customer will be contacted by the Customer Support.

    6.9. CINEMA TICKETS

    6.9.1. GENERAL
    6.9.1.1. TICKETS.UA LLC provides services to assist movie tickets realization according to the partnership agreements with providers.
    6.9.1.2. TICKETS.UA LLC is not responsible for the service delivery carried out by providers, as well as for accidents that may happen while watching a movie.

    6.9.2. PURCHASE
    6.9.2.1. Instructions for the use of the service “Cinema tickets” are essential terms of the Agreement, which may be found through the following links:
    https://kino.tickets.ua/en/content/cinema-how-to-book.html and https://kino.tickets.ua/en/content/cinema-how-to-pay.html
    6.9.2.2. The price of movie tickets is determined according to the effective rules and tariffs on the provider’s server at the moment of payment. In case of tariff and/or rule changes, the operations, which have been carried out according to the previous rules/tariffs, are valid and are not subject to reissuance.
    6.9.2.3. Voucher (electronic ticket) sent to the Customer’s e-mail shall be used as the payment confirmation of a cinema ticket. The voucher is also available in the section “My account.”
    6.9.2.4. Tickets shall be printed out by the Customer on his/her own at any time convenient to him/her. The printed tickets of the chosen cinemas shall be presented at the hall entrance or exchanged for a paper equivalent at the box office.
    6.9.2.5. If there is no possibility to print out the electronic ticket, another variant of ticket exchange for a paper equivalent is provided at a box office—a 13-digit code of the ticket under the barcode of the electronic ticket shall be given to the cashier.
    6.9.2.6. Keep the contents of your ticket (its code and graphic barcode) confidential, protect it against copying and third parties. If the contents of your ticket were copied because of your negligence, it may be deemed a physical loss of the ticket and an unknown person may use it.

    6.9.3. CALCULATIONS AND PAYMENT ORDER

    6.9.3.1. The price of each order includes payment gateway fee and is not refundable.

    6.9.4. TICKET REFUND RULES
    Ticket refund rules are essential terms of the Agreement, which may be found through the following link https://kino.tickets.ua/en/content/cinema-cancel.html
    6.9.4.1. Electronic tickets may be refunded no later than one hour before the beginning of the session.
    6.9.4.2. No fine for ticket refund is provided.
    6.9.4.3. Surcharge of the payment system is not refundable.
    6.9.4.4. If you exchanged your electronic tickets for usual ones (at a cinema box office or terminal), the tickets shall be returned to an administrator of the cinema, and then send a message with the information as follows (see below).
    6.9.4.4.1. In order to get a ticket refund, a message shall be sent to the following address: kino@tickets.ua. It shall contain:

    • name of the cinema and city;
    • reasons for refund;
    • number of the order;
    • numbers of the purchased tickets (the number is written under the barcode);
    • the last 4 digits of the credit card which was used for paying for the tickets.
    You will receive refund confirmation after its completion. Money will be returned only after receiving the confirmation from the cinema. Funds will be returned to the financial instrument through which the payment was done.
    6.9.4.5. If the Customer made payment (funds were charged), and the Customer did not receive payment confirmation for the Ticket to the Session (message with the Electronic ticket number), TICKETS.UA LLC return the Ticket price to the Customer.


    6.10. SERVICES PURCHASED VIA MOBILE APPS

    6.10.1. BOOKING
    On the Tickets.ua Website you may order flight and train tickets via iPhone and Android mobile applications.
    6.10.1.1. The Tickets.ua rules of the mobile applications use are inalienable conditions of the Agreement and could be found through the following links:

    6.10.2. SETTLEMENT AND PAYMENT PROCEDURE
    6.10.2.1. Payment for reservation via the mobile applications is made only with the Visa and MasterCard issued by the European, Ukrainian, or Russian banks.

    6.10.3. REFUND
    The refund procedure for tickets purchased via mobile applications is made according to provision 6.6.1.1.

    7. RIGHTS, DUTIES AND RESPONSIBILITIES OF THE PARTIES

    7.1. RIGHTS, DUTIES AND RESPONSIBILITIES OF THE BUYER
    7.1.1. The user has the right to:
    7.1.1.1. Use all available services and background information sections of the Site in order to select, purchase, or explore the available routes, prices, types and combination of services, as well as the terms of their providing.
    7.1.1.2. Use informational and consulting services of Technical Support Service of the site.
    7.1.1.3. Make purchases services for third parties or on their behalf only if the user was authorized to commit the selection and purchase of services, as well as to provide personal data required for registration services by these persons.

    7.1.2. The user shall:
    7.1.2.1. Report the passengers referred to in paragraph. 7.1.1.3. on the terms and conditions relating to bookings / purchases / conditions of use of the Service, executed by the Buyer for them or on their behalf, including all rules and restrictions applied, in due time.
    7.1.2.2. Carry out the terms and conditions of purchase established by any of the suppliers with whom it will co-operate within the selected services, including, but not limited to, the payment of all amounts at the appropriate time and in accordance with the rates, terms and limitations of the Supplier.
    7.1.3. The buyer and the passengers are responsible, informed and aware that:
    7.1.3.1. Any violation of any of the rights and terms of the Agreement, as well as the limitations of the Supplier may result in the cancellation of bookings / orders, denial of access to the purchased services without the refund being paid for the order, and / or the Site’s debiting the customer's account for the amount of the damage suffered as a result of such violations.
    7.1.3.2. All the stages of Order creation -- specification of the routes and dates, the choice of flights, filling in the data of Buyer and the passengers, the choice of payment methods, etc. - are only the independent choice of Buyer. Buyer is solely responsible for the accuracy of the data entered when booking. The information entered by Purchaser is automatically recorded in the booking system, the internal database of carriers, as well as in TICKETS.UA system for further development of the Order.
    7.1.3.3. Buyer shall be solely responsible for the compliance with the terms and regulations of the chosen supplier.
    7.1.3.4. Buyer acknowledges that some suppliers offering certain services and / or activities may require that Buyer should sign a remission of claim before using their services and / or participating in the activities they offer.
    7.1.3.5. The buyer and the passengers are fully responsible for the availability and correct execution of documents, visas, required for crossing the transit and destination countries’ borders. The validity of passports and other documents of the Passenger shall comply with the requirements of host countries.
    7.1.3.6. The buyer and the passengers are responsible for the timely provision of their visa and address data about the place of residence at the destination online the site, to make it possible to amend the information in the paid booking order if required by Carrier.
    7.1.3.7. The buyer and the passengers themselves are responsible for laying claims late or for non-compliance with the formalities.
    7.1.3.8. Fraud (or attempts of fraud) when buying a ticket online www.TICKETS.UA can lead to problems in obtaining visas, with direct check-in, etc.
    7.1.3.9. Fraud (or attempts of fraud) with bank credit cards entails liability in accordance with the applicable law.

    7.2. RIGHTS, DUTIES AND RESPONSIBILITIES OF TICKETS.UA

    7.2.1. "TICKETS.UA" LLC has the right to:
    7.2.1.1. Make any changes on the Site without the user’s being informed or warned: add new and / or reduce existing services of the supplier and / or the carrier, available online services and functionality; change the design or the rules of loyalty programs’ functioning; add / reduce the payment methods available for the users when paying for the order on the site; change the cost of its services; the amount of service fees and commissions levied at registration / purchase / return of the Services, at its discretion and at any time.
    7.2.1.2. Suspend the provision of services on the site with the aim of carrying out maintenance work without notice.
    7.2.1.3. Correct any errors in the price of services on the Site and / or created orders (either paid or unpaid), booked at the wrong price. In this case, the Purchaser will be asked to save the order with the correct price or to cancel booking without any penalty, if possible.
    7.2.1.4. Deny anyone access to this Site and offered services at its sole discretion at any time and for any reason, without any explanation or notice sent to User.
    7.2.1.5. Carry out the actions regulated in anti-fraud policy.
    7.2.1.6. Collect information on User’s orders made on the site with the purpose of notifying users about special offers, promotions and additional services available on the site.
    7.2.1.7. Offer users additional services, free or paid, such as the service notifying of the delay or cancellation of the flight in the form of SMS; the service of the search of r/w tickets, when they appear in the sale; the service of recommendations on choosing the hotel, when looking for the ticket; insurance services and other. Depending on the way the booking dialogue goes on, which offers additional services, its cost is either included in the total cost of the order, or it is suggested that it should be paid separately.

    7.2.2. "TICKETS.UA" LLC shall:
    7.2.2.1. Make every effort to serve the users of the Site properly.
    7.2.2.2. Inform buyers about changing the list of services or inability to perform the paid services, provided that the service provider and / or Carrier have timely informed the Party of "TICKETS.UA" about this.

    7.3. DISCLAIMER

    7.3.1. www.TICKETS.UA does not act as a provider co-operative with Service Provider whose services are selected by User, and is not involved in the disputes between the buyer and the service provider or the company providing services.
    7.3.2. TICKETS.UA does not provide legal services as well as it does not represent the interests of passengers owed to the carrier and service providers, as well as others.
    7.3.3. The user should be aware that the Site Support Services do not handle mail sent by User to the email address noreplay@tickets.ua, even if the information from the Site was received to this address.
    7.3.4. Under no circumstances is Tickets.ua responsible and does provide compensation for:

    • it also does not guarantee the accuracy and disclaims all liability for any errors or other inaccuracies, omissions, representations, warranties, violations or negligence relating to the goods and services of all Service Providers, available on the website,  without exception (including prices , area sketches, photos, lists, description of services, statistics, etc.), since most of this information is provided by the appropriate suppliers; or for different injuries, death, property or other kind of damage and additional expenses resulting from the above; for damage and loss incurred during the trips to various places around the world. Despite the competence and careful selection of service providers, the site has the ability to produce an all-out independent verification of the provided information services, but Tickets.ua will make every effort to ensure the customers’ being provided with services to the full extent;
    • in case of delays, cancellations, rerouting, excess reservations, oversight, force majeure or other reasons which are beyond our direct control, for damages or any other additional costs of Passengers brought about by the actions of any government or authority;
    • for the inconvenience and loss resulting from providing false information when using the Site;
    • for SMS not being delivered by communication systems or not being read by the customer in time, as well as for the customer’s timely checking his e-mail, specified when creating the order, and which all the information relating to the orders created on the site may be sent to;
    • in case of User’s neglect of the security and protection of personal data. If a third party has got unauthorized access to the account and other personal data of User that results in User’s incurring a loss;
    • for the quality of various channels of public communication, by means of which the User's access to the Service or support services human-operator is gained. And also if, when choosing the service, booking the order or paying for services, the server failure occurred as a result of poor communication.

    7.3.5. "TICKETS.UA" LLC is not liable to the User in case of full or partial nonoperability of the site and its components for any period of time, and in case of the users’ inability to get access to the site or incurring them any indirect or direct expenses resulting from the given circumstances. All offers, prices and also terms of sale can be: changed without the customer’s being informed, limited in time, availability of seats and the deadline terms of advance booking, dates of travel, the minimal or maximal time period of stay at the destination place, the factors of weekends and holidays, seasonal price fluctuations, waiting lists, as well as strikes and temporary nonoperability of booking systems and / or they may be subject to other changes, terms and limitations.

    7.3.6. "TICKETS.UA" LLC is not liable to the user for negative consequences and loss incurred as a result of the events and circumstances that are beyond its competence, as well as for the actions (or inaction) of a third party, namely:

    • In case of failure to fulfill the assumed obligations as a result of uncertainty, insufficient information and documents untimely provided by the user, or in case of the user’s violation of the terms of this Agreement or the requirements to the documents;
    • for the actions of carriers (change, cancellation, postponing, the delay the departure of flights, trains, buses and other vehicles, change in the cost of tickets, the withdrawal of tariff rates out of sale, cancellation of unpaid or paid bookings, for the safety, loss or damage to the baggage, cargo, valuables and documents of the passengers within the entire trip. In these cases, air carriers incur liability to passengers in accordance with international regulations and laws of Ukraine. The passengers’ claims are considered by the carriers on grounds of Ukrainian legislation and the rules of international transportation;
    • for the actions of customs and immigration authorities;
    • for limitation of passengers’ rights to travel from Ukraine or other point of departure by competent authorities of the country concerned;
    • for the actions of consulates of foreign countries, including the delay, denial or rescheduling the time period of issuing visas;
    • for the consequences of the violation of the customs and border formalities, rules of transportation and baggage allowance rules, as well as the violation of specific rules of conduct in the country of temporary residence by the passenger;
    • for the lack of the passenger’s travel documents received from the "TICKETS.UA" LLC ;
    • for the passenger’s failure to appear or late registration on the flight or to the place of the train departure;
    • for the non-observance by the passengers of the directions and rules of conduct on board of the aircraft established by the carrier;
    • for lack of passengers’ issued foreign passports or relevant papers regulating the departure of the young persons under 18 by the time of the beginning of the trip;
    • for the authenticity and accuracy of issuing the passenger’s papers (the accuracy of the information contained therein).

    7.3.7. The user (passenger) confirms and guarantees that he/she has read and agrees with the following:

    • the requirements for registration and the availability of documents required for the travel, and assumes the responsibility for the preparation of all the documents necessary for the trip. The passengers should get informed and comply with all the requirements of the country which he heads off to, including the requirements for the registration of documents necessary for the departure and arrival, the necessity of issuing visas, the purchase of a return ticket when entering the country with a visa-free regime for the citizens of a country that signed the appropriate agreement with Ukraine, or compliance with other necessary requirements necessary for entering the country (possession of health insurance for those traveling abroad, the proof of sufficient funds, etc.), the need for issuing other documents for traveling of minors under 18 or animals, permits for exporting weapons, art treasures and other permits and approvals. "TICKETS.UA" LLC bares no liability for the ignorance of the information or not meeting the requirements by the passenger;
    • the terms of application of tariffs, including the terms of the return and exchange of tickets as well as the terms of the carriers’ Connection flights, in case of transfer tickets issuing (the time sufficient for carrying out the transfer, registration of transit visas, etc.);
    • the requirements specified for foreign travel passport and other formal documents, including those of the residual period of validity of foreign travel passport, required for obtaining a visa and for entry into the host country;
    • special aspects and rules of the border (customs) control (mode) of Ukraine and foreign countries;
    • the obligation to keep the rules of customs and border procedures;
    • that passengers are solely liable for the validity of passports, authorization of minor travel and other documents required for crossing the border, and for the accuracy of the information contained in these documents;
    • that the deportation of a passenger with an invalid entry or exit documents is carried out for the passenger’s exclusive account. The passenger is obliged to obtain the necessary information about the deportation order at the consulate of the country concerned.

    8. PROCEDURE OF DISPUTE SETTLEMENT

    8.1. Any disputes that may arise with respect to this Agreement shall be settled through negotiations. All matters not regulated by this Agreement shall be subject to the law of Ukraine.
    8.2. The legislation of Ukraine shall apply to all the relations arising from this Agreement.

    9. POHIBITED ACTIVITIES

    9.1. It is prohibited:

    1. To use this website or its contents for commercial purposes.
    2. To use TICKETS.UA service in any way that violates any provisions of this Agreement and / or any article of the current legislation.
    3. To use any hardware and / or software meant for:
    • damaging the infrastructure of the Site, violating its timely and correct functioning;
    • the attempts to intercept any data and personal information processed by the Site;
    • pursuing any action that may load on the infrastructure of the Site and other systems associated with the service of users or with providing services by the site;
    • monitoring, automated extraction of information or copying any data, content and / or information from this Site by any means, for any purpose, without the express written permission of www.TICKETS.UA.
    10. DISCLAIMER

    10.1. Should any part of this Agreement appear to be illegitimate, null and void or that becoming inoperative, it will not bring about the invalidity of the agreement as a whole.
    10.2. The print version of this Agreement and any communication message sent by electronic means shall be accepted in any judicial procedures and in administrative implementation based on this Treaty it relates to the Treaty and is subject to the same terms as other business documents and business books that have been produced straight off and stored in a printed form.
    10.3. We offer a great variety of travel services which may include additional features, if a customer orders them by subscribing to our service. In this regard in some cases additional terms may be employed.
    10.4. The Services and additional options provided by the Site may concern:
    10.5. The user must carefully read each of these documents, and give his consent to act strictly in respect of these rules when ordering / activating any of the services.
    10.6. You agree that no joint venture, partnership or employment relations between you and TICKETS.UA will appear as a result of this Agreement or using this Site.
    10.7. Carriers, Hotels, Insurers and others providing tourist and other services on this Site are independent contractors and not agents or employees of the company.
    10.8. The Carrier or the Service Provider companies bare full responsibility for the carriage of passengers and providing travel services.
    10.9. The means of information and reference support available in different sections of the Site (schedules, flight delays statistics, rankings, reference-books and guides, weather, news on tourism, information materials on countries, cities, events, etc.) are designed exclusively for the Site Members for fact-finding.
    10.9.1. All the data on schedules, flights, arrival and departure boar, flight delays statistics, weather are provided by the relevant fact-finding companies, that is why the reliability and accuracy of these sections are of liability of www.TICKETS.UA. The site www.TICKETS.UA is not responsible for any changes in schedules and reference services.

    11. FORCE MAJEURE

    11.1. The Parties are released from liability for complete or partial failure to perform or improper performance of the parties’ obligations hereunder if such failure was caused by force majeure arising after the conclusion of this Agreement.
    11.2. The circumstances of force majeure include fire, natural disasters, military operations of any kind, epidemics, the acts of legislative and executive power impeding compliance with obligations, changes in immigration policy, terrorism, and other circumstances beyond the reasonable control of the Parties. Deadline for the fulfillment of obligations under the Treaty is delayed according to the time during which such circumstances still have effect.
    11.3. The Party which appeared to be unable to fulfill its obligations hereunder, shall immediately notify the other Party on the emergence (or termination) of the circumstances referred to in paragraph 11.2. of the present Agreement. Failure to notify or untimely notification of the indicated circumstances shall deprive the parties of the right to refer to these circumstances and shall not exempt from liability under this Agreement. The time of performance of obligations by the Parties under the present contract is extended in proportion to the period of time during which such circumstances have effect. If the circumstances continue for more than fourteen (14) days, each party will have the right to refuse to perform its obligations hereunder. The existence of the indicated circumstances is to be confirmed by the relevant decisions of the Chamber of Commerce of Ukraine or other competent authority.
    11.4. In the event of these circumstances, the parties have the right to seek in court for termination of the contract.

    12. TERMINATION OF THE AGREEMENT

    12.1. "TICKETS.UA" LLC is entitled to modify or otherwise edit this Contract without informing the user at any time, at its sole discretion. The further use of this website by the User means that the User has automatically accepted the amended or edited Agreement.
    12.2. This Agreement may be terminated at any time at the initiative of the User or "TICKETS.UA" by sending the other party a notice by mail.
    12.3. "TICKETS.UA" LLC has the right to terminate the Agreement at any time without previous notice if the User violates the order and terms of booking and payment services.

    13. DURATION

    13.1.     The Agreement shall come into force upon its conclusion (acceptance of offer), and is valid for an indefinite period of time.

    14. DATA PRIVACY

    14.1. The principles of personal data protection of the client of "TICKETS.UA" are stated in Privacy Policy section and are an integral part of this Agreement.

    15. ANTI-FRAUD POLICY

    15.1. The principles and methods of actions against fraud and fraud attempts by "TICKETS.UA" are set out in Anti-Fraud Policy section and are an integral part of this Agreement.
    15.2. "TICKETS.UA" LLC reserves the right to investigate any illegal and / or unauthorized use of this Site, including, but not limited to unauthorized use of robots and other automated devices with regard to the Site, and to take a series of appropriate legal actions, in accordance with the Law Ukraine, so as to prevent damage or to claim for damage.

    16. COPYRIGHT

    16.1. All materials on the site belong to "TICKETS.UA" LLC or its partners. All materials are protected by copyright and intellectual property rights, including, but not limited to website design, names, trademarks, logos, text, software, database rights and other elements of the site's content. ©2014 TICKETS.UA All rights reserved.
    16.2. The user has no right to copy, distribute or otherwise use or reproduce the content of the Site or the basic code either partially or completely without the preliminary agreement with "TICKETS.UA".

If the user is absolutely sure that the material we publish, violates his copyright,  either the user or his representative can send us the original or scanned copy of the written notification, containing a clear description of the material that violates the law; the proof that the rights have been violated; the contact information of the sender; personal signature.
